A subpoena is a request for the production of documents, or a demand to appear in court or other legal proceeding. It is sometimes court-ordered (“so ordered” by a judge) and essentially requires the recipient (witness) to testify or present information that may help support the facts that are at issue in a pending case.

 

The term “subpoena” literally means “under penalty”. A person who receives a subpoena but does not comply with its terms may be subject to civil or criminal penalties, such as fines, jail time, or both.

Obtaining Judge’s Signatures on Orders to Show Cause and on “So Ordered” Subpoenas

Subpoena are sometimes required to be “So Ordered” and signed by a judge to compel compliance with the Subpoena.  After the subpoena is properly filled out, it must be presented to the Court Clerk’s Office. The Clerk will forward it to the Judge.
